These Terms of Service (the "Terms") govern your use of the Life&Let platform (the "Platform") and all services provided by Life&Let, ("Life&Let," "LifeandLet," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you are not authorized to use the Platform.

In these Terms, the following terms have the following meanings:

"Content" means any text, graphics, images, software, and logos that you provide to Life&Let for use in the marketing and online management of your holiday let properties. "Holiday let property" means any property that you own or manage for holiday letting purposes." Marketing and online management services" means the services provided by Life&Let to you, which may include, but are not limited to, the following:

- Developing and implementing a marketing strategy for your holiday let properties.

- Creating and managing online listings for your holiday let properties.

- Handling booking inquiries and reservations for your holiday let properties.

- Providing customer support for guests of your holiday let properties.

- Providing reputation management services across online travel agencies accounts and social media for the Client's holiday let properties.

- Management of social media across various platforms for the Client's holiday let properties.

- Marketing through various channels, which may include, but are not limited to Email, SMS, Facebook, Instagram, TikTok.

User Accounts

To use certain features of the Platform, you may be required to create an account. When creating an account, you agree to provide accurate and complete information about yourself and to keep your account information up-to-date. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

User Conduct

You agree to use the Platform in a lawful and responsible manner and to comply with all applicable laws and regulations. You agree not to use the Platform for any unlawful purpose or in any way that could damage the Platform or its operation. You also agree not to use the Platform to:

- Transmit any material that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or otherwise objectionable.

- Transmit any material that contains software viruses, worms, Trojan horses, or other harmful code.

- Interfere with or disrupt the Platform or servers or networks connected to the Platform.

- Violate any applicable laws or regulations.

Content

You are responsible for ensuring that all Content provided to Life&Let is accurate, complete, and up-to-date. You also agree that the Content does not infringe any third-party rights, including, but not limited to, copyright, trademark, or privacy rights.

Intellectual Property

The Platform and all content and materials on the Platform, including, without limitation, text, graphics, images, software, and logos, are the property of Life&Let or its licensors and are protected by copyright, trademark, and other applicable intellectual property laws. You agree not to use, reproduce, modify, distribute, display, perform, create derivative works from, or otherwise exploit any of the content or materials on the Platform without the prior written consent of Life&Let or its licensors.

Life&Let respects your privacy and is committed to protecting your personal information. Please refer to our Privacy Policy for more information about how we collect, use, and disclose your personal information.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LIFE&LET MAKES NO WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of Liability

IN NO EVENT SHALL LIFE&LET BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF LIFE&LET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE PLATFORM OR THE MARKETING AND ONLINE MANAGEMENT SERVICES, EVEN IF SUCH DAMAGES ARE CAUSED BY LIFE&LET'S NEGLIGENCE OR OTHER WRONGFUL ACT. LIFE&LET'S TOTAL LIABILITY FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE MARKETING AND ONLINE MANAGEMENT SERVICES DURING THE SIX (6) MONTHS PRECEDING THE DATE OF THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN LIABILITIES, SO SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, LIFE&LET'S LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
